1. Introduction

Welcome to Corpelia Farms. These Terms and Conditions ("Terms") govern your access to and use of our products, services, website, and any agreements entered into with Corpelia Farms (Pty) Ltd (“Corpelia”, “we”, “our”, “us”). By purchasing goods or hiring services from us, you agree to be legally bound by these Terms.

2. Scope of Services

Corpelia Farms provides the following services:

• Tractor and TLB machinery hire
• Agricultural consulting and support services

3. Booking & Orders

3.1 Equipment hire

All bookings for tractor and TLB services must be made in advance and are subject to availability. A signed hire agreement and proof of payment (or deposit) are required before release of equipment.

3.2 Crop or Livestock Orders

Orders for produce or livestock must be confirmed in writing or via official communication channels. Pricing is subject to availability and may fluctuate seasonally.

4. Payment Terms

• All services and products are payable in South African Rand (ZAR).
• Payment terms are Cash on Delivery (COD) unless otherwise agreed in writing.
• Late payments may attract interest at the prevailing prime rate plus 2%.
• Corpelia reserves the right to withhold services or goods until payment is received.

5. Cancellation and Refund Policy

5.1 Services

Cancellations for equipment hire must be made at least 24 hours in advance to avoid forfeiture of deposit. No refunds will be issued for services already rendered.

5.2 Goods

Crop and livestock orders are non-refundable once delivered, unless the goods are materially defective upon inspection. Returns are subject to review and must be reported within 24 hours of delivery.

6. Liability & Indemnity

• Corpelia shall not be liable for any indirect, incidental, or consequential loss resulting from the use of our products or services.
• Clients are responsible for ensuring the safe and proper use of any hired equipment.
• You agree to indemnify Corpelia Farms, its staff, and agents against any claims, damages, or losses arising from your use of our goods or services.

7. Equipment Use Terms

• Machinery is hired out with or without operators (as requested).
• Fuel, transportation, and operator fees (if applicable) are billed separately.
• Any damage caused through negligence or misuse will be charged to the client.

8. Intellectual Property

All website content, branding, logos, product names, and promotional material are the property of Corpelia Farms and may not be reproduced or distributed without written permission.

9. Privacy & Data Protection

All personal information collected is processed in accordance with the Protection of Personal Information Act (POPIA). Please refer to our Privacy Policy for more details.

10. Force Majeure

Corpelia shall not be held responsible for any failure to perform its obligations due to circumstances beyond its control, including but not limited to acts of nature, strikes, unrest, or supplier delays.

11. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved amicably. If unresolved, disputes will be referred to mediation or arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any legal proceedings shall be instituted in the appropriate South African courts.

13. Changes to Terms

We reserve the right to amend these Terms at any time. Updates will be posted on our website or made available upon request. Continued use of our services constitutes acceptance of the revised Terms.
